Terms
Draft. Before launch we add the operator's name and address, and a lawyer reviews these texts.

1. Scope
These terms apply to the use of the RallyRoads app and website, operated by [NAME] ("we"). By creating an account you accept them. The privacy policy explains how we handle your data.
2. Age and driver's license
You must be at least 16 to create an account in the EU and at least 13 elsewhere. To drive a route as the driver, you must be at least 18 and hold a valid driver's license for the vehicle. Younger people can come along as passengers or co-drivers.
3. Road safety
Traffic law and road signs always take priority over any instruction in the app. The driver does not operate the device while driving. Checkpoints are only done when parked. Routes have no timing or speed scoring, and RallyRoads is never a race.
4. Your own risk and road conditions
Driving carries risks that we cannot control. You decide whether the road, the weather, the traffic, your vehicle and your own condition allow a route, and you drive at your own risk. Routes describe the road as it was when it was researched. Roads can be closed, damaged, under construction, closed for the season, unpaved or impassable, and opening hours or access rules can change. Check local conditions before you set off, and turn around if a road is unsafe or closed. Offroad routes follow tracks that were legally open when they were researched; local rules and signs always apply.
5. Your routes and content
If you publish routes, photos or comments, you confirm that you hold the rights to them and that they follow these terms. You grant us a non-exclusive, worldwide, royalty-free license to host, show and distribute them in the app and on our website. We remove unlawful or dangerous content, and repeated violations lead to suspension. If a third party makes a claim against us because content you published infringes their rights or the law, you indemnify us, to the extent you are responsible for it. Publishing and selling routes is also governed by the creator terms.
6. Purchases and subscriptions
Subscriptions renew automatically and can be canceled any time in your App Store or Google Play settings, at the latest 24 hours before the end of the current period. If you cancel during the free trial, you are not charged. Purchased routes stay unlocked for as long as the app is offered. Apple's or Google's terms also apply to payment and refunds.
7. Creator revenue
Creators receive 70% of the net revenue we actually receive (after VAT or sales tax and the store fee) from single sales of their routes, and a share of the Pro pool. The details are in the creator terms.
8. Warranty
The app and the routes are provided "as is" and "as available". To the extent permitted by law, we make no warranties, express or implied, including of merchantability, fitness for a particular purpose, accuracy or uninterrupted availability.
9. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, lost profits or lost data, and our total liability for all claims is limited to the greater of the amount you paid us in the 12 months before the claim and USD 50.
10. Consumers in the EU, the EEA and the UK
If you are a consumer whose habitual residence is in the EU, the EEA or the UK, sections 8 and 9 do not apply to you. Instead, your statutory warranty rights apply. We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and under any guarantee we have given. For slight negligence we are liable only for breach of an essential contractual obligation, one whose fulfillment makes the contract possible and on which you may rely, and only for the typical, foreseeable damage.
11. Termination
You can stop using the app at any time and delete your account (Garage → Settings → Delete account); cancel running subscriptions in your store settings. We can suspend or close an account for a serious or repeated breach of these terms, for example dangerous or unlawful routes or racing content, after a warning where that is reasonable.
12. Changes to these terms
We tell you about changes to these terms at least 30 days before they take effect, in the app or by email. Changes that significantly affect your rights or obligations need your consent, which we ask for in the app; if you do not agree, you can delete your account. Changes never affect routes you have already bought or the price of a period you have already paid for.
13. Apple
If you downloaded the app from the App Store, Apple's standard Licensed Application End User License Agreement (EULA) also applies. These terms are between you and us, not Apple; Apple is not responsible for the app or its content.
14. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection law of your country or state of residence remains unaffected, and you can also bring claims in the courts there. If a provision of these terms is invalid, the rest stays in force.
